12:17:56 PM Commissioner White I would make a motion to waive the park dedication requirement of, that is in the staff report and I believe that waiving the dedication complies with 76-3-621 and that, in that section of statute it talks about that, two points, (a) It says that the development permanently sets aside for park recreation which is sufficient to meet the needs of the persons that reside in the development and they have shown that in testimony and then also (b) It talks about preliminary plat provides for long-term protection of and there's a number of things, but the big thing that this specifically addresses the agricultural interest and the area of land proposed to be subdivided by virtue of a combination of the provisions (a) and (b) above is reduced by amount equal to or exceeding the area of dedication required, does
that. I would just have that as my motion.
